Appeal Filed

 

On October 11, the Temporary Restraining Order against the governor's original order expired. That day, Judge Urias, the federal judge our lawsuit is currently before, allowed the Governor's amended order banning firearms at parks and playgrounds in Bernalillo County to go into effect. The judge sided with the Governor who argued her original order was moot and only the amended order was under consideration.Under the Bruen decision at the supreme court, there is a loophole for "sensitive places" where firearms can still be banned. The judge, a Biden appointee, opined there is an open question on whether or not parks and playgrounds meet the "sensitive places" definition. Since the judge did not believe we showed a strong enough likelihood of ultimately prevailing in our lawsuit, he declined to issue the preliminary injunction against the governor's amended order.Our lawsuit was consolidated with five others also suing the governor over her order. Last night, after consulting with our fellow parties, we filed an appeal with the 10th Circuit Court of Appeals challenging the decision on the preliminary injunction.We will continue this fight, but we need your support too.
